Broker shall be deemed to earn a referral fee if all the following conditions have been met:

(1) Buyer/Agent holds a valid real estate license in the state in which the property is located and does not represent the Seller or Auctioneer. Buyer must acknowledge representation by Broker/Agent for this property and auction transaction,

(2) Broker / Agent registers the above named Client via fax or email 48 hours prior to auction with Auction Alliance/Loftin Auction,

(3) Client is not previously registered with another Broker / Agent,

(4) Broker / Agent shows the property to Client prior to auction and attends auction with Client,

(5) Broker / Agent, as principal employee, affiliate or immediate family member, is not qualified to earn a referral fee for this transaction,

(6) Client complies with terms of Purchase and Sale Agreement, terms and conditions of auction, and closes on the property.

The referral fee on an offer submitted through Auction Alliance/Loftin Auction and accepted prior to the auction will be 40% of the buyer’s premium received as commission by Auction Alliance/Loftin Auction. The referral fee at the auction will be 15% of the buyer’s premium received as commission by Auction Alliance/Loftin Auction or 2.5% of the written opening bid submitted on this form, whichever is greater. A 10% buyer’s premium is the standard commission and applies to most auctions. No more than one referral per client will be recognized. Some properties require specific property Broker Referral forms which must be downloaded for that specific auction. The proper referral form will have property address and auction date pre-printed on the form. All disputes or claims will be settled by Auctioneer at Auctioneers discretion.
