SALE SITE & DATE:
Auction will be held on site, rain or
shine, Tuesday, October 12, 2010 10:00 am.
REGISTRATION:
Although there is no obligation
to bid, all prospective buyers must register.
PREVIEWS:
Real Estate: Oct 4, 11-1pm.
Equip: Oct. 11, 2-4 pm. Bank Financing Available.
TERMS:
Real Estate
— All properties require 15%
down auction day, balance in 30 days upon closing. Of the 15% earnest money
payable at the auction, $2,500.00 for each tract must be in a cashier check or
certified funds. Buyers will endorse checks over to Auctioneer upon being
awarded the bid. Balance of earnest money may be paid by personal or company
check.

Buyer's premium will be added to final bid on all real estate and personal
property.
Personal Property -
Cash
or guaranteed funds in full auction day. 10% Buyer's premium will be added
to final bid on all real estate and personal property.
CLOSING:
In 30 days on or before November 11, 2010.
Seller warrants title to the property, and Seller will furnish good and
marketable title free and clear of any and all liens, mortgages, and
encumbrances. Seller will pay for preparation of deed and State of Georgia Property Transfer Tax. Buyer will pay all
other closing costs. Title insurance will be available at buyer’s expense.
BANK FINANCING AVAILABLE:
Qualified buyers may be pre-approved
for special bank financing.

CONDITIONS:
Property will be sold "as is —
where is" without expressed or implied guarantee or warranty. All information
was derived from sources believed to be correct but is not guaranteed, and is
subject to errors, omissions, corrections, additions, deletions, prior sale and
withdrawal. All measurements are approximate. Buyers shall rely on their own
information, judgment, and prior inspection of the property and records. Auction
announcements take precedence. Seller will furnish good and marketable title to
property.
POSSESSION:
Real Estate: Upon closing with
delivery of deed and 4:00 pm auction day for personal property.
TAXES:
Prorated to date of closing.
ANNOUNCEMENTS:
Announcements by Auctioneer take precedence over previous oral statements,
advertising, printed materials, and terms and conditions. The terms of the
Purchase and Sale Agreement are controlling in the event of perceived
inconsistencies between its terms and any statements in advertising or printed
material. Seller reserves the right to add or delete any property, reject any
bid or bids, or cancel the sale. The Auctioneer reserves the right to decide all
questions on all bids, change the order of sale, accept or reject bids, bid or
rebid, reopen the bidding, sell or resell, and/or add or delete property or
items at his discretion. In the case of any disputes or questions on the bid,
the Auctioneer shall make the sole and final decision.
AGENCY DISCLOSURE:
Auctioneer represents the
Seller in the offering and sale of this property.
